UPDATE & ACTION ALERT: 2 pieces of legislation NOW in US Congress to STOP usurping of US Constitutional War Powers by Obama Administration... GET INVOLVED !
After contacting my representatives office about supporting House Concurrent Resolution 107, I just got information from them that we actually now have House Concurrent Resolution 107, and a second piece of legislation pending in the form of an actual bill, H.R. 1609, The War Powers Reform Act of 2011 that are now BOTH in the Judicary Committee to be heard. HR 1609 was introduced by Representative Chris Gibson (N.Y.). It currently has 25 cosponsors, and it has been referred to the Rules Committee as well as the Judiciary Committee. The bill repeals a portion of the War Powers Resolution that requires the President to submit a report to Congress within 60 days of initiating military action. Instead, this bill prohibits funds from being used to support military action unless there is a declaration of war, a specific statutory authorization, or a national emergency caused by an attack or an imminent attack on the U.S.
H.Con.Res.107 – states “That it is the sense of Congress that, except in response to an actual or imminent attack against the territory of the United States, the use of offensive military force by a President without prior and clear authorization of an Act of Congress violates Congress's exclusive power to declare war under article I, section 8, clause 11 of the Constitution and therefore constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution.”
To review these pieces of legislation and others I would encourage you to visit this website:http://thomas.loc.gov/home/thomas.php In the center column be sure to click the Bill Number Radio button and enter the Bill number (i.e. H.Con.Res. 107 or H.R. 1609).
In the United States Congress, a concurrent resolution is a resolution passed by both the House of Representatives and the Senate but is not presented to the President and does not have the force of law. In contrast, joint resolutions and bills are presented to the President and, once signed or approved over a veto, are enacted and have the force of law. Concurrent resolutions are generally used to address the sentiments of both chambers or deal with issues or matters affecting both houses...
It is also my understanding that my Congressman, The Honorable Rep. Jeff Miller (R) of the 1st Congressional District of Florida, from the panhandle area, is a co-sponsor of HR 1609.
PATRIOTS IT IS UP TO US "WE THE PEOPLE", TO CONTACT OUR SENATORS & CONGRESSMEN, OR CONGRESSWOMEN, AND TELL THEM AS OUR ELECTED REPRESENATTIVES TO SUPPORT BOTH OF THESE EFFORT TO DEFEND OUR CONSTITUTION & THE RULE OF LAW WHICH THEY SWORE TO PROTECT, DEFEND & UPHOLD IN THEIR OATHS OF OFFICE!
